Sunsuria Group ventures into Mont’ Kiara with a 26-storey office block and nine floors of car park. However, the project is temporarily put on-hold as residents nearby have objected to the development plan.

Really Damansara. Where it is Damansara by name and location. Just a stone’s throw away from Tropicana City Mall, the live-work-play components of Glomac Damansara will surely fulfill a fully self-sufficient and self-contained environment. Exciting tenants unveiled ahead of Sunway Putra Mall’s opening on 28 May 2015 Registration

Putra Place, as it was previously known, was a unique 3-in-1 mixed development comprising The Mall, a 8-storey shopping complex, plus a 25-storey Legend Hotel & Service Apartments and the Putra Place office tower which covered the tenth to the 33rd floor.

The freehold property had a retail space of 193,621 sq ft and as many as 1,323 parking bays over 3 basement levels. It is strategically located on Jalan Putra opposite the Putra World Trade Centre and Seri Pacific Hotel, previously Pan Pacific Hotel.

The Mall was launched on 12 June 1987 by then Prime Minister, Tun Dr Mahathir, who personally buried a time capsule that will be unearthed after a century, in 2087. The capsule contains a message written by Mahathir and is addressed to the citizens of the future.

The shopping complex once had Malaysia’s first Yaohan Departmental Store which operated from the mall’s opening in 1987 until 1997. Most Kuala Lumpur residents would have remembered the iconic Yaohan store was a major gathering point for city residents and foreign visitors to KL.

The then Commerce International Merchant Bankers Bhd (CIMB) put the property up for auction in April 2008 to recover loans given to the property owner, Metroplex Holdings Sdn Bhd. The auction price was then set at RM705 million and subsequently was reduced thrice as no bids were received.

In April 2011, Sunway Real Estate Investment Trust (SREIT) via its trustee OSK Trustees Bhd announced its intention to purchase the entire Putra Place for RM513.95 million in what was believed to be the largest public auction in Malaysia at that time.

At that time, the mall had an occupancy of over 70%, while about 90% of the office is tenanted and the hotel was operating at 60% month-to-month occupancy.

SREIT was then involved in a series of legal tussles with the previous owner Metroplex, which saw three lawsuits filed against SREIT by Metroplex to stop the transference of ownership, occupancy and management rights of Putra Place.

Metroplex and its holding company as well as another bidder at the public auction and three existing tenants have also instituted legal proceedings, amongst others, challenging the validity of the auction and seeking enforcement of the tenancy agreements with the former owner.

On 20 February 2012, the Federal Court had decided in favour of the trustee and the manager or in some cases, struck out the cases by Metroplex and its holding company.

Sunway REIT Management Sdn Bhd, the manager for SREIT, then proceeded with a major renovation of the property under a RM300 million turnaround exercise which began in May 2013.

The hotel and office components was renovated on a progressive basis and will be slated for completion six to nine months later than the opening of the mall.

The property was then renamed Sunway Putra Place, of which the three components will be known as Sunway Putra Hotel & Serviced Apartments, Sunway Putra Tower and Sunway Putra Mall.

Besides covering renovation works on the existing infrastructure, the mall’s gross floor area was increased by 90,000 sq ft with a new retail extension block housing a 8-screen cineplex and a “Sundrop Diamond” element, which is a transparent gem-like structure claded in colourful glass at the centre of the mall.

The refurbished mall will have a net lettable area of 578,000 sq ft. Its tenant mix is planned to appeal to the mid- to middle-upper income groups, including smaller groups of affluent residents from nearby Bukit Tunku, Damansara Heights and Bangsar.

Overlooking the Putra World Trade Centre (PWTC), the Umno building and the Seri Pacific Hotel (formerly Pan Pacific Kuala Lumpur), the retail mall component provides surrounding visitors, office workers and residents an exciting new place to shop, dine and entertain with its 8 levels of shopping floors.

Sunway Putra Mall comprises 4 signature zones such as the Vanity Hall for women beauty, Market Place for essentials, Selera Street for local and international cuisines and eye-catching Asian Avenue for Asian fashion trends, ICT and street foodies.

Remembering the old days will be easy, especially when the landmark street-like fare “Medan Hang Tuah” in the former The Mall will be restored to its old charm.

How To Calculate The Transaction Costs For Subsale Property Purchase Registration

The process flow for a purchaser buying a property in resale/subsale or secondary market is explained in Process of Buying a Property In The Secondary Market.

 

Completing the property deal

A purchaser would have to execute the SPA and Loan Agreement (if cash buyer, this is not applicable). It is highly desirable that a purchaser executes his or her SPA and Loan Agreement with different lawyers.

The purchaser signs both the SPA and Loan Agreement. Once that is done, the lawyer will follow up from there to stamp the agreements and perform the transfer registration at the land office registry, which normally should not take more than 3 months from the signing date.

 

Sale and Purchase Agreement (SPA)

According to Investopedia, the Sale and Purchase Agreement (SPA) is a legal contract that obligates a purchaser to buy and a seller to sell a product or service.

SPAs are found in all types of businesses but are most often associated with real estate deals as a way of finalizing the interests of both parties before closing the deal.

 

What do I have to pay when executing a SPA and Loan Agreement?

When executing a SPA and Loan Agreement, a purchaser has to pay the following:

(1) legal or lawyer fees payable to the appointed lawyer who will prepare the SPA and Loan Agreement,

(2) stamp duty payable to the government and it will be collected by the lawyer on behalf of the government, and

(3) disbursement and miscellaneous costs incurred by the lawyer in preparing the said documents.

 

Legal fees for SPA and/or Loan Agreement

The legal scale fees are as follow: 

 Consideration or Adjudicated Value  Scale Fees  For the first RM150,000  1.0% (subject to a minimum fee of RM300)   For the next RM850,000  0.70%  For the next RM2,000,000  0.60%  For the next RM2,000,000  0.50%  For the next RM2,500,000  0.40%  Where the consideration or adjudicated value is in excess  of RM7,500,000  Negotiable on the excess (but shall not exceed 0.4%  of such excess)

 

Having in mind the above legal scale fees, a purchaser may normally negotiate for discounts on legal fees at the discretion of the lawyer, and the final price is normally confidential between the purchaser and the lawyer. 

For property price exceeding RM7.5 million, legal fees of the excess RM7.5 million is negotiable.

Below is an example calculation:  

 First RM150,000 @ 1.0%  RM1,500  Next RM850,000 @ 0.70%  RM5,950  Next RM2,000,000 @ 0.60%  RM12,000  Next RM2,000,000 @ 0.50%  RM10,000  Next RM2,500,000 @ 0.40%  RM10,000  Next RM3,000,000 @ 0.20% (negotiated rate)  RM6,000  Total Legal Fees  RM45,450

 

Stamp duty on SPA

A purchaser of a property has to pay stamp duty to the government when the purchaser buys a property.

 

How to calculate the stamp duty payable on SPA?

The stamp duty chargeable on the SPA is RM10 each.

The stamp duty chargeable on the Memorandum of Transfer (MOT) is calculated based on the property purchase price (as per SPA). The rates are mentioned as follow:-

 First RM100,000  1.0%  RM101,000 to RM500,000  2.0%   From RM501,000 and above  3.0% 

 

Stamp duty on Loan Agreement

The stamp duty chargeable on the Loan Agreement is RM5 for every RM1,000 of the loan amount, or 0.5% on loan amount.  

 

When should these documents be stamped?

All SPAs and Loan Agreements executed in Malaysia are to be stamped within 30 days of their execution.

If the SPAs and Loan Agreements are executed outside of Malaysia, the duration for stamping remains the same, which is 30 days after they have been first received in Malaysia.

As for the MOT, it has to be sent to the stamp office for adjudication to determine whether the stamp duty is chargeable based on the contract price or the market value of the property.

The MOT shall be stamped within 30 days from the date of the notice of assessment.

 

Penalty on document not stamped within time

If a document is not stamped within the timeframe, the purchaser will have to pay, in addition to the stamp duty payable, a penalty and the rates of the penalty are as follow:-

 Duration of Delay  Penalty Rate  Within 3 months after the time of stamping  RM25 or 5% of the duty, whichever shall be greater  Later than 3 months but not later than 6 months  RM50 or 10% of the duty, whichever shall be greater   Later than 6 months  RM100 or 20% of the duty, whichever shall be greater

 

The purchaser may appeal to the Collector of Stamp Duties for reduction of penalty.

 

The consequence of a document not duty stamped

A document which is not stamped or insufficiently stamped is not void or unenforceable for that reason alone.

However, such document may be rejected as evidence if it is required to be produced before the Court.

In that event, the party who wishes to produce the unstamped or insufficiently stamped document will have to pay the stamp duty payable and penalty before such document can be received as evidence.

Thailand’s Onyx Hospitality Group signed two more new properties in Malaysia Registration

UMCity Medini Lakeside in Nusajaya, within the Iskandar Malaysia’s flagship zone B, is a RM1 billion integrated lifestyle development uniquely located next to a lake, offering an exclusive enclave for business and living. It will be developed by leading lifestyle property developer United Malayan Land Bhd (UMLand).

Besides Onyx’s properties, The Ascott Limited will also manage service residences here under Citadines Medini Nusajaya, while MBO Cinemas will anchor the retail podium with the latest cinematic halls under MCAT Box Office and Regus Serviced Offices will feature the first professional business suites in Nusajaya.

Scheduled to open in 2018, the OZO Medini will feature 198 guest rooms alongside all other facilities for which the select-service, stylish smart brand is known for, including, ‘EAT’ the place to go for signature breakfast ‘boost’, ‘EAT2Go’ the grab and go outlet, swimming pool ‘SPLASH’, fitness centre ‘TONE’ and rooftop lounge ‘BOMU’.

Offering the epitome of style, comfort and luxury, Shama Medini will comprise of 232 managed service residences complete with spacious living areas, ideal for business travellers and families looking for space and comfort. The property will also feature lakeside views, a restaurant, a kids club, a fitness centre, and a rooftop garden with an outdoor barbeque.

Commenting on these projects Onyx Hospitality Group president Peter Henley said:

The upmarket Amari Johor Bahru will open in 2016 with 242 rooms. The hotel is part of the Suasana Iskandar Malaysia development which also offers serviced apartments for sale and a retail podium. The hotel will offer a selection of Amari’s signature features including an Asian Food Gallery, Breeze Spa and Idea Rooms (meeting rooms).

Subsequently, Onyx Hospitality Group has also signed up Malaysia’s first OZO-branded hotel in Penang. The OZO Georgetown Penang, located on the edge of UNESCO World Heritage site in the centre of Georgetown, will open its doors in 2017 with 132 guest rooms.

According to a source, Onyx Hospitality Group is said to be studying the Kuala Lumpur market for potential colaborations and hotel openings. No firmed deals have been made so far.

Onyx Hospitality Group manages the select-service OZO brand, the upscale Amari brand and the luxury Saffron brand. It also manages the upscale service residence Sharma brand, luxury residences such as Oriental Residence Bangkok and two spa brands, namely Maai and Breeze. Its managed restaurants such as the Mantra Restaurant & Bar in Amari Pattaya is well-known and award-winning in Thailand.

OZO Wesley Hong Kong is the first OZO property and was launched in May 2013, followed by OZO Chaweng Samui in Koh Samui in March 2014, OZO Colombo in May 2014, and OZO Pattaya in September 2014. OZO Kandy Sri Lanka has just opened last quarter.

The first Amari hotel was opened in Doha, Qatar in January 2013. Subsequently, 12 more Amari hotels and resorts opened in Thailand including the Amari Buriram United, the only football-themed hotel in Thailand; and 1 hotel opened in Dhaka, Bangladesh.

The Shama luxury managed service residence is an established apartment brand founded in Hong Kong since 1996. The brand is catered for the long-stayers and family-bringing market. The brand has regional presence in Shanghai, Hangzhou, Hong Kong and Bangkok.

Onyx Hospitality Group is a member company of ITALTHAI Group, one of Thailand’s leading conglomerate with a regional presence and employing over 5,000 people. ITALTHAI Group was founded by Thai billionaire Dr Chaijudh Karnasuta and his Italian friend Giorgio Berlingieri in 1955. The company is now helmed by Dr Chaijudh’s children, the sister and brother team Nijaporn Charanachitta and Premchai Karnasuta.

The River City at Danga Bay transforms Johor Bahru into regional destination Registration

The RM2.5 billion Phase 1 of The River City @ Danga Bay project aims to clean, beautify, revitalise and create a new riverfront city along both riverbanks of 6km portion of the 15km-long river, Iskandar Waterfront said in a statement today.

Iskandar Waterfront is a joint venture between Kumpulan Prasarana Rakyat Johor and businessman Tan Sri Lim Kang Hoo, who is also executive vice chairman of Iskandar Waterfront.

The massive development will have five primary components, to be called as such:

  • The Venice: themed riverfront buildings with vibrant entertainment and shopping conveniences;
  • The Gateway: where a new city downtown will be created;
  • The Rivera: urban living by the river;
  • The Bund: a new growth centre infused with historical and heritage elements; and
  • The Fisherman’s Wharf: a place for festivals, parties and marine lifestyle.

“We will make Sungai Danga (Danga River) come alive with river cruises, boardwalks, street sculptures, lifestyle malls, food, entertainment and other water sports facilities under this development,” said Johor Menteri Besar Datuk Seri Mohamed Khaled Nordin at today’s launch.

He said Phase 1 of the The River City project will cover 52 acres and cost a total of RM2.5 billion to develop.

Also included in the masterplan will be hotels, serviced apartments and office suites complemented with waterfront alfresco facilities, retail outlets, riverfront promenades, special lighting and a landscaped 6km-long boardwalk along the riverbank.

The highlight will be two man-made islands with thematic architectural features to showcase Malaysia’s rich ethnic and cultural diversity.

Lim said another two man-made islands will be added under Phase 2 of the development.

The River City plan will be the second most-expensive clean-up of a waterway river after the Malaysian government’s RM4 billion multi-year project to clean up the meandering Klang River in Kuala Lumpur and Selangor. 

Last week, a Monetary Authority of Singapore (MAS) board member Lawrence Wong gave this perspective in Singapore Parliament when he warned that a glut of private residences in Johor could cause a fall in property values. 

Wong, also Minister for Culture, Community and Youth of the city state, said many Singaporeans have invested in the Iskandar Region.

In response, Mohamed Khaled said: “Singapore is always wary about their people coming here (Johor). Johor is more attractive because our cost of living is lower, so house prices in Johor is very affordable for a Singaporean.”

Across the Causeway, the clean-up of the Singapore River and Kallang Basin in 1997 resulted in the successful reinvigoration of what had once been the dirtiest waterways in the island republic.

The Singapore government not only breathed new life into the rivers, but also transformed them to become desired locations for waterfront housing, and entertainment and dining establishments.

Today, the river sparkles with life and exudes a vitality for the enjoyment of everyone.

Bombay Palace Restaurant torned down, makes way for Bombay Tower Kuala Lumpur Registration

The North Indian cuisine restaurant was previously housed in a well-preserved 2-storey colonial bungalow at the junction of Persiaran Stonor and Jalan Tun Razak. It is located directly opposite Japan Embassy across Persiaran Stonor and the US Embassy across Jalan Tun Razak.

The landowner, Tong Ah Company Sdn Bhd, is believed to be redeveloping the bungalow site into a 32-storey corporate office tower tentatively called Bombay Tower.

The glassy-looking squarish office block will have 6 levels of podium carpark and 4 levels of basement carpark.

A recent visit to the site revealed that substructure works have started and that the entire bungalow has been demolished. Several upcoming luxury residences are being planned next door such as Aria KLCC Serviced Residence, 10 Stonor, Stonor 3 and a private project.

This is again another old world charm that has silently diminished from the sight of the general public and media. Presumably, no efforts were made to preserve its colonial architecture and creatively incorporating them into the design of the new office tower.

Since the demolition of the 77-year-old Bok House on Jalan Ampang in 2006, many city folks and even visitors to Malaysia have expressed their sadness over the destruction of the building, saying that old buildings like Bok House should be preserved.

During the old days, Tong Ah was known to be a distributor of liquor and spirits. The company is now involved in the distribution of traditional Chinese medicine and herbal products.

The company is also currently building a 6-storey budget hotel on Jalan Sultan, near Petaling Street, which is Kuala Lumpur’s Chinatown.

According to Bombay Palace Restaurant website, it claimed to be the world’s largest authentic North Indian fine-dining chain of restaurants. Bombay Palace Restaurant has been operating in Kuala Lumpur since 1994.

The award-winning restaurant offers heritage recipe from India and amongst its signature dishes are mango lassi, palace sizzling grill, zinga masala, palak paneer, chicken makhni, kulfi and family naan.

The restaurant has international branches in New York City, Washington D.C., Beverly Hills, Toronto, Ontario, Montreal, London and Hyderabad.

The Kuala Lumpur branch is now opened for business in Life Centre at Jalan Sultan Ismail.

UEM Sunrise signs up HYATT House hotel brand for Arcoris Mont’Kiara Registration

Property developer UEM Sunrise Berhad (UEM Sunrise) is believed to be concluding the management agreement with Chicago-based Hyatt Hotels Corporation for the introduction of a HYATT house™ hotel at the developer’s integrated development known as Arcoris Mont’Kiara.

Designed by global renowned architectural firm Foster + Partners, the freehold development comprised of two terracing blocks of 18- and 35-storeys. Both blocks are linked by a courtyard central plaza which contains retail units and lush greens.

The 18-storey northern block is dedicated to private service residences, while the 35-storey southern block contains 262 units of business suites, 336 units of SoHos and a boutique hotel.

The southern block’s hotel portion is where Southeast Asia’s first HYATT house™ hotel will be established. The hotel opening date has not been finalised but is expected to be within 2016 after the entire 6-acre development is completed.

The hotel property will have 275 suites and it will become the first ever hotel in the heart of the Mont Kiara enclave. Mont Kiara is widely known as an affluent, expatriate address that is a mere 6km away from Kuala Lumpur city centre.

Highlights of the hotel include lush roof gardens on every floor, uniquely themed room interiors, and quite possibly the best views in Mont Kiara thanks to its rooftop facilities deck.

With foreign arrivals set to increase significantly in the coming years, Kuala Lumpur once again played host to a new hotel brand in the region, being the first HYATT house™ location in the region. 

Hyatt Hotels Corporation currently managed three HYATT properties in Malaysia, including Grand Hyatt Kuala Lumpur in KLCC vicinity, Hyatt Regency Kinabalu and Hyatt Regency Kuantan Resort.

Launched in 2012, the HYATT house™ brand was designed to welcome residents rather than guests.

HYATT house™ is a boutique hotel concept that will evolve the extended-stay model into a social and modern environment where guests are frequently reminded like residents living in an upscale apartment community.

The core values of the HYATT brand are very much instilled here. The hotel will be designed to surprise and delight with services, amenities, upscale spaces and a casual, comfortable environment that will remind guests of home.

With an average of 125 to 200 suites per property, the brand exemplifies residentially-inspired studios, one- and two-bedroom suites that feature contemporary full kitchens within the suites, living space with flat panel HDTVs and bedrooms with a plush bed.
